These Terms of Service (“Terms”) govern your access to and use of the MedPlate application and website (“MedPlate” or the “Service”), provided by Digital Caregivers LLC (“Digital Caregivers,” “we,” “us,” or “our”). By using MedPlate, you agree to these Terms.
1. About MedPlate
MedPlate is a product of Digital Caregivers LLC that provides general informational guidance about food and medication considerations.
2. Not medical advice
MedPlate is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, pharmacist, or other qualified healthcare provider with any questions about your medications, diet, or a medical condition. Never disregard professional medical advice or delay seeking it because of something you read in MedPlate.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use MedPlate.
4. Your account
- You are responsible for the accuracy of the information you provide.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- Notify us promptly of any unauthorized use of your account.
5. Acceptable use
You agree not to:
- Use the Service to violate any law or the rights of others.
- Reverse engineer, scrape, or interfere with the Service or its underlying systems.
- Upload malicious code or attempt to gain unauthorized access.
- Use the Service to provide medical advice to others or as part of clinical decision-making without independent professional review.
6. Subscriptions and payments
Paid features are billed in advance on a recurring basis according to the plan you select. You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
7. Intellectual property
MedPlate, including its software, content, and branding, is owned by Digital Caregivers LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.
8. User content
You retain ownership of the information you submit. You grant Digital Caregivers a worldwide, royalty-free license to use, process, and display that content solely to operate and improve the Service.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL CAREGIVERS LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless Digital Caregivers LLC from any claims, damages, or expenses arising out of your misuse of the Service or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time.
13. Governing law
These Terms are governed by the laws of the State in which Digital Caregivers LLC is organized, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in that jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service. Your continued use after changes take effect constitutes acceptance.
